    if the traffic is encrypted they cant tell what you are doing wat, its just data that movies with no means of piecing together the content

    I suspect they actually do their own torrenting to get a list of IP addresses, match that to a timestamp and ask the ISP for a list of users matching both criteria. Knowing our ISP...

    There's been allegations (possibly out of spite or for smear) that the company has been downloading fansubs for their own purpose.

    They can still grab all the IP addresses connecting to a certain torrent. That is usually sufficient to shoot a letter at you to claim infringement. The fact is they don't even need to prove that data is actually transmitting. So far that is how they work be it RIAA/MPAA. See the 'scary' letter, they only provide the connecting IP address.
